The rules for using this site.

Plain-English terms governing your use of the Berala Dental website. Designed to be fair and transparent — the kind of terms we'd want as patients ourselves.

Acceptance of terms.

These Terms of Use ("Terms") govern your access to and use of the website at beraladental.com.au (the "Site") and any related services (the "Services") operated by Aly's Dental Services Pty Ltd, ABN 36 139 765 012, trading as Berala Dental ("we", "us", "our").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

These Terms are not a contract for the provision of dental services. The terms governing dental services we provide to you are set out separately at the time of booking or in our patient consent forms.

Who we are.

Berala Dental is a private dental practice located at 184 Woodburn Road, Berala NSW 2141. The practice is operated by Aly's Dental Services Pty Ltd (ABN 36 139 765 012), an Australian Private Company registered for GST since 1 October 2009.

Our practitioners are registered with the Dental Board of Australia through the Australian Health Practitioner Regulation Agency (AHPRA) and practise in accordance with the regulatory framework set out under the Health Practitioner Regulation National Law (NSW) No 86a.

Content is educational.

All content published on the Site — including blog articles, FAQs, service descriptions, the CDBS checker tool, downloadable resources, and any other written or visual content — is provided for general educational and informational purposes only.

Our website is intended to:

  • Help you understand how dentistry works in Australia
  • Explain the services we offer at our practice
  • Provide general oral-health education
  • Help you make an informed decision about whether to book a consultation with us

It is not intended to be promotional, sensational, misleading, or to make claims that are not supported by current clinical evidence. Where we describe services, we describe them in factual terms.

Content is not medical or dental advice.

If you have a dental concern, please book a consultation by phone, in person, or via WhatsApp. Our team will arrange an examination and provide advice tailored to your situation.

Dental emergencies.

🚨 Emergency notice

If you are experiencing a medical emergency (severe bleeding, difficulty breathing, swelling that affects breathing or swallowing, signs of stroke or heart attack, severe trauma), call 000 immediately or go to your nearest hospital emergency department.

For urgent dental issues during clinic hours, call us on (02) 9649 6468. Outside hours, call healthdirect on 1800 022 222 for advice or visit a hospital emergency department for severe pain, infection or trauma.

Information on our website about dental emergencies (e.g. what to do for a knocked-out tooth) is general guidance only. Always seek immediate professional care.

Bookings & appointments.

You may request a booking through our online booking tool, by phone, by WhatsApp, or by email. Submitting a booking request through the Site does not automatically confirm an appointment. An appointment is confirmed only when our reception team responds with a confirmation (by phone, SMS, email, or WhatsApp).

We reserve the right to:

  • Decline or reschedule any appointment request, particularly where availability or clinical suitability is a factor
  • Decline to treat any patient where, in our reasonable clinical judgement, treatment is not appropriate or where there is a serious breakdown of the practitioner-patient relationship
  • Charge a reasonable cancellation or no-show fee where appointments are cancelled with less than the notice period set out in our practice policies — patients will be informed of this policy at the time of booking

CDBS Eligibility Checker tool.

The CDBS Eligibility Checker on this Site is a free service that allows parents to send their Medicare and child details to our reception team to verify Child Dental Benefits Schedule eligibility through Medicare's HPOS portal.

  • The result returned to you is the result we obtain from Medicare's official portal at the time of the check. CDBS eligibility is determined by Services Australia, not by us.
  • A positive eligibility result does not guarantee any specific treatment outcome, cost, or coverage of services beyond what the CDBS scheme covers
  • Eligibility can change. We recommend re-checking eligibility each calendar year, particularly if your family's Family Tax Benefit Part A status changes.
  • Submitting the form is not a booking. If we confirm eligibility and you wish to proceed, we will book you a consultation as a separate step.
  • How your information is handled when you use this tool is governed by our Privacy Policy.

User conduct.

When using the Site, you agree that you will not:

  • Use the Site for any unlawful purpose or in a way that is harmful, harassing, threatening, or defamatory
  • Submit false, misleading, or fraudulent information through any form
  • Use the CDBS checker, contact form, or any other tool to test, probe, or attack our systems
  • Attempt to gain unauthorised access to the Site, our systems, or the systems of our service providers
  • Introduce viruses, malware, or other malicious code
  • Scrape, harvest, or systematically copy content from the Site without permission
  • Attempt to identify or contact other patients through the Site
  • Impersonate any person or entity

User-submitted content.

From time to time, the Site may allow you to submit content (such as comments, feedback forms, or reviews). When you submit such content:

  • You confirm that you own the content or have the necessary rights to submit it
  • You confirm that the content is true, accurate, and not misleading
  • You grant us a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute that content in connection with the operation of our practice and Site
  • We reserve the right to remove, edit, or refuse to publish any content at our discretion, particularly where it breaches these Terms, AHPRA's advertising guidelines, or applicable law

In line with AHPRA's Advertising Hub guidelines, we do not publish patient testimonials about clinical aspects of regulated health services on the Site.

Intellectual property.

The Site and all its content — including text, graphics, logos, images, photographs, audio, video, software, and the overall design and arrangement — are owned by or licensed to Aly's Dental Services Pty Ltd and are protected by Australian and international copyright, trade mark, and other intellectual property laws.

You may:

  • View, browse, and read the Site for personal, non-commercial purposes
  • Print or download a single copy of a page for your own personal reference
  • Share a link to a page on the Site

You may not (without our prior written consent):

  • Reproduce, republish, or distribute Site content elsewhere
  • Modify or create derivative works from Site content
  • Use Site content for commercial purposes
  • Remove or alter any copyright or trade mark notices
  • Use any of our logos, brand colours, or trade marks in a way that suggests endorsement or association without our consent

Third-party links.

The Site may contain links to third-party websites (such as Services Australia, AHPRA, Health Direct, professional bodies). These links are provided for convenience and do not imply our endorsement of the linked sites or their content. We are not responsible for the content, privacy practices, or availability of third-party websites. You access them at your own risk.

Site availability & changes.

We aim to keep the Site available and operating correctly, but we don't guarantee continuous, uninterrupted, or error-free operation. The Site may be unavailable due to maintenance, technical issues, or events outside our control.

We reserve the right at any time to:

  • Modify, suspend, or discontinue any part of the Site
  • Update content (including correcting errors)
  • Change features or layouts
  • Restrict access in particular circumstances

Limitation of liability.

To the maximum extent permitted by law:

  • The Site and its content are provided "as is" and "as available", without warranties of any kind, express or implied
  • We do not warrant that information on the Site is current, accurate, complete, error-free, or fit for any particular purpose, beyond the warranty implied by the Australian Consumer Law where it cannot be excluded
  • We are not liable for any direct, indirect, incidental, special, consequential, or exemplary loss or damage arising from your use of, or inability to use, the Site
  • This includes (but is not limited to) loss of profits, loss of data, loss of goodwill, business interruption, or personal injury arising from reliance on Site content
  • Where our liability cannot be excluded by law, our liability is limited to (at our option) re-supplying the relevant service or paying for it to be re-supplied

Australian Consumer Law.

Nothing in these Terms is intended to exclude, restrict or modify any rights you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), or any other consumer protection law that cannot be lawfully excluded. Where our liability cannot be excluded by law, the limitations in these Terms apply only to the extent permitted by law.

Indemnity.

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising from:

  • Your use or misuse of the Site
  • Your breach of these Terms
  • Your breach of any applicable law or regulation
  • Your infringement of any third party's rights, including intellectual property rights

AHPRA & advertising compliance.

As registered dental practitioners, we are bound by AHPRA's Guidelines for Advertising Regulated Health Services issued under section 133 of the Health Practitioner Regulation National Law. We have taken care to ensure all content on the Site complies with these guidelines.

If you believe any content on the Site is inconsistent with the AHPRA Guidelines (for example, that it is misleading, creates unrealistic expectations, or contains a prohibited testimonial about a regulated health service), please contact us at hello@beraladental.com.au and we will review it promptly.

Privacy.

Your privacy is governed by our separate Privacy Policy, which forms part of these Terms by reference. By using the Site, you agree to the collection, use, and disclosure of your information as described in that Policy.

Termination.

We may suspend or terminate your access to the Site at any time, without notice, where we reasonably believe you have breached these Terms or where suspension or termination is otherwise reasonably necessary to protect our practice, our patients, or our systems.

Governing law.

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the exclusive jurisdiction of the courts of New South Wales (and any courts hearing appeals from those courts) for any dispute arising under or in connection with these Terms.

Changes to these terms.
